Your use of our services is governed by the Graton Privacy Policy, Graton Acceptable Use Policy, Merchant Terms of Use, and other legal agreements applicable to you as a Graton customer (collectively referred to as the “Related Agreements”). By continuing to use this website (www.gratongroup.com) (“Website”) or any of our services through acceptable mediums, you agree to abide by these Terms and all Related Agreements.
Conflict Resolution
In case of conflict between these Terms and any Related Agreements, the specific terms of the Related Agreements shall prevail concerning the particular service accessed by you in conflict. We reserve the right to amend these Terms at any time by posting a revised version on our website, effective upon posting unless otherwise noted. Amendments reducing your rights or increasing your responsibilities will be notified with a 5-day advance notice from the publication date.
About Us
Graton Financial and Technology Services Limited operates as an online payment aggregator, facilitating seamless, efficient, and cost-effective online transactions among individuals or companies within and beyond borders. We provide website and service access as an independent contractor on an independent service provider basis. Graton does not control, assume liability for, or guarantee the products or services paid for using our service, nor the identity of any user or completion of transactions between buyers and sellers.
Our Services
Your use of the Services is subject to these Terms, applicable Related Agreements, and regulations stipulated by relevant authorities. We reserve the right to impose necessary limits, restrictions, and conditions on your use of the Services at any time, with or without prior notice. You agree that we are not liable for such limitations, restrictions, or conditions affecting you or your business.
Refund: In case of failed or incomplete transactions, upon your written request, we will refund the amount (including any fees charged) through the original payment method used for the transaction (e.g., credit card, debit card, or direct debit).
Chargeback: Graton reserves the right to request reimbursement for chargebacks approved by us, as per relevant payment scheme rules and acceptable under the law.
Fees: Transaction fees are detailed in the relevant Related Agreement executed with us and disclosed each time you initiate a transaction. Using your credit card as the payment method might incur a cash-advance fee from your card issuer.
Dispute Resolution
You agree to promptly notify us of any unauthorized or problematic transaction carried out using your account to prevent financial loss. All claims related to payments against us must be made within 45 days from the payment date; otherwise, you waive claims against us to the fullest extent permitted by law after this period. Graton holds no liability for goods and services paid for using our Services, solely serving as a payment aggregator. While we may intervene in disputes, we are not obligated to do so. Provide us with relevant transaction IDs and/or details to resolve disputes.
Intellectual Property
Using Graton software grants you a revocable, non-exclusive, non-transferable, limited license to access and use it according to the accompanying documentation. This includes software updates, upgrades, new versions, and replacement software. You may not transfer your software rights to a third party or breach specified use requirements. Graton reserves the right to update or discontinue any software upon notice. No rights to third-party materials are granted, and modifying, reproducing, distributing, or reverse-engineering Graton’s software or third-party materials is prohibited.
Restricted Activities
In connection with your use of the Website or Services, you must not:
- Breach these Terms or any related agreement with Graton.
- Violate any laws, statutes, or regulations.
- Infringe on intellectual property rights or sell counterfeit goods.
- Engage in defamatory, threatening, or harassing behavior.

- Violate card system rules or abuse the Services.

Potential Actions Against You
If we discover your engagement in restricted activities, we reserve the right to:
- Terminate these Terms and suspend access to Services.
- Refuse future Services.
- Disclose your actions to relevant third parties or law enforcement.
- Update inaccurate information provided by you.
- Pursue legal action against you.
You are responsible for liabilities resulting from your breach of this agreement or use of Graton’s services.
Assignment
You may not transfer or assign your rights or obligations under these Terms without Graton’s prior written consent. Graton reserves the right to transfer or assign these Terms at any time.
Age Restriction
Our website and services are not intended for children under 18, and we do not knowingly transact with or provide services to them.
Disclaimers
While we strive to maintain a bug-free, secure website and Services, your use of them is at your own risk. The Website and Services are provided “as is,” without express or implied warranties. We do not guarantee uninterrupted or error-free services.
Limitations of Liability
In no event shall Graton or its affiliates be liable for indirect, special, or consequential damages exceeding the transaction amount or twenty thousand United States Dollars (US$20,000.00), whichever is lesser. This includes, but is not limited to, loss of revenues, profits, goodwill, or business interruption.
Exclusions
Certain jurisdictions might not permit the exclusion of warranties or limitations of liability for specific damages. Consequently, some disclaimers and limitations may not apply to you to the extent prohibited by applicable law.
Applicable Law
These Terms shall be interpreted and governed by the laws of the Federal Republic of Nigeria. Legal disputes shall be referred to arbitration at the Lagos Multi-Door Courthouse under the Lagos State Arbitration Law 2009. The arbitrator’s findings and award will be binding, and each party shall bear its costs.
Court Orders and Regulatory Requirements
Graton may be obligated to take certain actions upon receiving legal notices or to comply with applicable law or regulatory requirements. We will decide the necessary actions in our sole discretion and notify you unless otherwise mandated by law.
Severability
If any part of these Terms is deemed invalid or unenforceable, it shall be severed without affecting the validity or enforceability of the remaining provisions.
